Brookland Campus General Rental Policies and Procedures/Waiver

 

Rental space cannot be utilized for any unlawful purpose.
Activities cannot disturb regular Brookland campus functions.
Persons reserving space must be at least 21 years of age or have a guardian present at all times.            All facilities must be closed and vacated by 11:00 pm Sunday through Thursday and by 1:00 am Friday and Saturday.
All rentals must be made through the campus Events Coordinator.
The Brookland campus reserves the right to refuse any rental.
Smoking is strictly prohibited in any campus buildings.
Permission to rent space on the campus does not in any way constitute an endorsement of a group or person's policies/ beliefs.
Brookland will be responsible for all facility set up and break down for all rentals.
Brookland deserves the right to determine number of personnel required to perform any of services required in accordance with the contract (security and an administrative fee may apply to events larger than 100 persons in attendance and/or held after 5:00 PM during the week and on week-ends.)
Each person connected with the use of the campus shall abide by, conform to and comply with all the laws of the United States and the State of South Carolina and the ordinances of the City of West Columbia.
In the event that the Brookland campus or any part thereof is destroyed by fire or any other casualty unforeseen occurrence, the contractual agreement will be adjusted accordingly.
Persons renting Brookland property are responsible for removing all goods, wares ,etc, associated with specific event.
Persons renting Brookland property shall abide by all seating capacity as specified by written guidelines.
Persons renting Brookland property shall not injure or mar, or in any manner deface the campus. (No tape, tacks, nails, screws, bolts and no items hanging from the ceilings/light fixtures are allowed)
Brookland reserves the right to approve all service providers associated with any event.
Persons renting Brookland property will not post or allow to be posted or exhibited signs, advertisements, show bills, posters, etc inside or in front of any part of the campus except in approved areas.
The sublet of a rental agreement is strictly prohibited.
Persons renting Brookland property shall not do or permit to be done anything in or upon any portion of the campus which will in any way conflict with the conditions of any insurance policy (all activities involving oils, explosives, fluids, gasoline or any other chemical or mechanical matter must be approved prior to use).
Persons will be charged a late fee as per rental guidelines for events extending beyond the rental agreement.
Persons renting Brookland property will be responsible for replacing or repairing any damaged to the facility or its furnishings.
If a rental agreement is held in default by the renter, the renter is responsible for any legal fees and cost of arbitration.
Brookland reserves the right to issue additional rules, regulations and written orders to provide for the operation and use of the Brookland Campus in a commercially reasonable manner.
Brookland shall not discriminate against a person or class by reason of age, sex, handicap, color, creed, religion, sexual orientation or national origin.
Persons renting Brookland property will assume all costs arising from the use of patented, trademarked, franchised or copyrighted music, materials, devices, processes or dramatic rights used on or incorporated in an event.
Brookland shall retain the right to cause the interruption of any performance in the interest of public safety, and to likewise cause the termination of such performance when in the sole judgment of such act is necessary.
The Brookland campus is a place of "public accommodation" and is in compliance with the American With Disabilities Act (Public Law 101-336((the "ADA").
Brookland reserves the right to relocate the designated area to an alternative comparable space within the campus if such relocation should become necessary by a reasonable nature. Such relocation will not constitute a breach of contract.
Any dispute or claim arising directly or indirectly may be submitted to binding arbitration in Columbia, South Carolina. In accordance to the rules of the American Arbitration Association.
Brookland or the renting entity may terminate or suspend its obligation under this agreement if such obligations are delayed, prevented or rendered impractical by any of the following events to the extent such event is beyond reasonable control of either party: fire, flood, riot, earthquake, civil commotion, insurrection, Act of God, strikes, labor disputes.

All notices required or permitted to be given to any party shall be in writing and delivered personally, or sent by registered or certified mail, return receipt requested or by overnight air courier service. All such notices to either party shall be deemed to have been provided when delivered, if delivered personally or refused by those individuals or entities involved.
Brookland assumes no responsibility whatsoever for any property placed on campus by a renter. Brookland is expressly relieved and is discharged from any and all liability for any loss, injury or damage to persons or property that may be sustained by reason of the occupancy of the Brook-land campus (unless caused by gross negligence or willful misconduct). Brookland campus officers, trustees, agents and employees will not be required to assist renter with any activities at the facilities.
Renter agrees that the Brookland campus shall not be liable for any direct, indirect, incidental, specified, consequential or exemplary damages, whether personal or relating to property of any guests. Renters and guest use the campus at his/her own risk. All guests each intending to be legally bound hereby, for themselves and their heirs, legal representatives, successors and assigns, do hereby waive and release to the fullest extent allowed by law any and all rights and claims for damages (against Brookland officers, directors, trustees, employees, agents, volunteers, contractors or members) for any and all injuries, damages or causes of action suffered or alleged to have been suffered and to hold Brookland harmless from and against any and all damages, losses, expenses, liabilities, claims, demands of whatsoever nature (not limited to defects in equipment, fixtures and/ or the premises of the Brookland campus.
Renter agrees that any claim or cause of action arising out of or related to renter or guest of the use of the Brookland campus must be filed within one (1) year after such claim on cause of action arose or be forever barred. Furthermore, renter and the Brookland campus agree to submit any dispute arising to final and binding arbitration with the City of West Columbia, Lexington County, South Carolina using the American Arbitration Association's Commercial Rules.
